Equal Credit Opportunity Act (Regulation B)

The Equal Credit Opportunity Act (ECOA) directs the Consumer Financial Protection Bureau (Bureau) to prescribe regulations to carry out the ECOA's purposes. See 15 U.S.C. 1691b(a). The Bureau issued a proposed rule that would facilitate compliance with ECOA by clarifying the obligations imposed by the statute. The comment period for that proposed rule closed on December 15, 2025.

Financial Data Transparency Act

The Department of the Treasury, Federal Reserve Board, OCC, CFPB, SEC, FDIC, FHFA, and the NCUA coordinated efforts on a proposed rule establishing data standards for the collections of information reported to each agency by financial entities under their jurisdiction, and the data collected from the agencies on behalf of the Financial Stability Oversight Council (FSOC). If finalized as proposed, the rule would implement the requirements of section 124 to the Financial Stability Act of 2010 (12 U.S.C. 5321 et seq.), which was added by the James M. Inhofe National Defense Authorization Act for Fiscal Year 2023 (NDAA). The NDAA requires the agencies to jointly issue the final rule within two years of enactment.

Protections for Borrowers Affected by the COVID-19 Emergency Under the Real Estate Settlement Procedures Act (RESPA), Regulation X, Rescission

The Consumer Financial Protection Bureau (Bureau) has issued an interim final rule rescinding the CFPB's final rule Protections for Borrowers Affected by the COVID-19 Emergency Under the Real Estate Settlement Procedures Act (RESPA).

Rescission of State Official Notification Rules

The Consumer Financial Protection Bureau (Bureau) issued a direct final rule that would have rescinded the Bureau's procedures by which a State official must notify the Bureau when the official takes an action to enforce the Consumer Financial Protection Act, but the Bureau withdrew the direct final rule because significant adverse comments were received. The Bureau is currently evaluating the comments.

Small Business Lending Data Collection Under the Equal Credit Opportunity Act Reconsideration

In May 2023, the Bureau published a final rule implementing section 1071 of the Dodd-Frank Wall Street Reform and Consumer Protection Act. The final rule, as modified by subsequent extensions of compliance dates, became effective on August 29, 2023. The Bureau issued a proposed rule to reconsider certain aspects of the May 2023 final rule. The comment period for that proposed rule closed on December 15, 2025. Personal Financial Data Rights Reconsideration

In November 2024, the Consumer Financial Protection Bureau (Bureau) published a final rule pursuant to section 1033 of the Consumer Financial Protection Act. The final rule became effective on January 17, 2025. The Bureau plans to take the rulemaking steps necessary and appropriate to reconsider the November 2024 final rule. Registry of Nonbank Covered Persons Subject to Certain Agency and Court Orders; Rescission

The Consumer Financial Protection Bureau (Bureau) rescinded its rule requiring certain types of nonbank covered persons subject to certain final public orders obtained or issued by a government agency in connection with the offering or provision of a consumer financial product or service to report the existence of the orders and related information to a Bureau registry.
